Leaving the UK? Your First Step Is Becoming Non-Resident

If you're planning to move abroad and embrace life as an expat, the first and most important step is to determine your UK tax residency status. Whether you're relocating permanently, trying out life overseas, or considering a more nomadic lifestyle, becoming non-resident for UK tax purposes is crucial.

This decision sets the foundation for how your income, assets, and gains will be taxed - not just in the UK, but worldwide.

What Changed in 2013?

Before April 2013, UK tax residency was a murky area full of grey zones and inconsistent rules. That all changed with the introduction of the Statutory Residence Test (SRT) - a formal, legal framework HMRC now uses to determine whether you're still a UK resident for tax purposes.

As you'd expect from HMRC, the SRT is detailed, technical, and weighted heavily in the UK’s favour. If there’s any chance they can still tax you, they will.

What Is the Statutory Residence Test?

The SRT works through a series of steps and tie-breaker rules, covering things like:
How many days you spend in the UK
Whether you have a UK home
Your UK work commitments
Where your immediate family live

Depending on your circumstances, the SRT can confirm your non-residency quickly — or leave you caught in a complex middle ground where every detail matters.

Why It’s Worth Getting Right

If you don’t meet the requirements for non-residency (or misjudge your status) you could find yourself unexpectedly paying UK tax on your overseas income, property sales, or capital gains.
